(1) Hoius käesoleva seaduse tähenduses on krediidiasutuse ja hoiustaja vahelisest lepingust tulenev hoiustaja tähtajaline või tähtajatu kehtiv nõue krediidiasutuse vastu. Nõude rahalist väärtust kajastab krediidiasutus maksetehingute täitmiseks peetaval kontol või tema klientide vahendite hoiustamiseks peetaval kontol. Krediidiasutus peab nõude põhisumma õigusaktide või lepingu tingimuste kohaselt hoiustajale tagasi maksma.
(2) Hoius käesoleva seaduse tähenduses on ka summa, mille ülekandmiseks hoiustaja või muu isik on oma nimel ja arvel andnud maksejuhise, mida krediidiasutus ei ole hoiuste peatamise päeva seisuga täitnud.

(1) For the purposes of this Act, a deposit shall mean a valid claim for a specified or unspecified term of a depositor against a credit institution arising from the contract between the depositor and the credit institution. A credit institution shall record the monetary value of the claim in an account kept for the execution of payment transactions or in an account kept for depositing the clients' funds. A credit institution shall repay the principal amount of the claim to a depositor pursuant to the legislation or terms and conditions of the contract.
(2) For the purposes of this Act, a deposit also means a sum for the transfer of which depositors or other persons have issued a payment order in their name and for their own account but the credit institution has not executed the payment order by the date on which deposits become unavailable.
